    The Proposed Constitution of Aluvean Seas

    Introduction:

    As fellow members of the NationStates community, we acknowledge that we are a part of this great region known as Aluvean Seas. Here, we hold true to the idea of being a collection of independent-sovereign nations that share

    Article 1: Citizenship

    Citizenship is the first step into becoming a member of Aluvean Seas. To be a citizen is to show that your nation upholds the same ideals and beliefs we hold within the region and that you are committed to be an active member of our community.

    Admittance -

    To be admitted to membership within Aluvean Seas, a prospect member must abide to the following procedure to be admitted.

    1. The prospect member must have received a letter or telegram of invitation from the Founder, Lord Duke, or WA Delegate and must show proof to either host.
    2. The prospect member must be in good standing within the NationStates community. After receiving conformation from either the Lord Duke or WA Delegate and upon a background check with the NationStates moderators, the prospect member will receive a telegram of acceptance into the region and be made a full member.
    3. After being admitted, the newly admitted member nation must register onto the Aluvean Seas forum to validate their membership within the region.

    Rights and Responsibilities -

    All members of the Aluvean Seas is entitled to the following rights within the region.

    1. The right to vote in any and all elections and amendments brought forth within the region. Every nation in the region has a voice to be heard and to help direct the course of the region.
    2. The right to run for the office of WA Delegate or Lord Duke within the Aluvean Seas government.
    3. The right to host role-playing sessions within the regional forum.
    4. The right to draft and propose laws and amendments to the Constitution.

    All members of Aluvean Seas are charged with the following responsibilities.

    1. All member nations of Aluvean Seas should and are encouraged to be active on the regional forums; but are not required to.
    2. All member nations of Aluvean Seas may not give any secret info to any other region in the game unless instructed to. If they do they will be banned from the region.
    3. All member nations of the Aluvean Seas must practice in the use of clean posting and role-playing within the region forums and RMB. We have to be aware that NationStates host a wide range of people and we need to protect ourselves and our reputation from harm. Any and all vulgar messages and posts (overly sexual, bestiality, graphic, racist, etc) will result in loss of membership within the region and the possibility of a permanent ban from the Aluvean Seas.

    Article 2: Government of Aluvean Seas

    The purpose of the Regional Government is to create and enforce laws that benefit the members of Aluvean Seas while also serving as the face of the region to the outside world. The Regional Government will be known as the Royal Council. The Royal Council will be made up of all the elected and non elected officers of the Regional Government with the purpose of managing the day-to-day tasks and running of Aluvean Seas. The members within the Royal Council serve in an executive role within the government and will be made up of the following positions:

    1. Founder – Serves in an advisory role for the region to enforce the Constitution and laws of Aluvean Seas. Has the power to eject and ban members/nations for breaking the laws within the region. As such, the Founder is barred from running for election for the position of Lord Duke as the position of Governor-General holds the same power as Lord Duke.
    2. Lord Duke – The elected head of Aluvean Seas. Oversees the operations of all Aluvean Seas actions and enforces the Constitution to the members of the region. Duties include but are not limited to: Serves as the elected head of state for the region, Appoints his/her Vice Duke, Oversees and moderates the Aluvean Seas forum along with the Founder, Create new lordship positions as needed with the advisement from the Royal Council and Founder, Acts in any other specified duties as approved by the Royal Council and Founder.
    3. Vice Duke – Appointed by the Lord Duke and acts in his/her place. Helps the Lord Duke and Founder enforce the Constitution and, in conjunction with the Lord of Recruiting, recruit new members into the region.
    4. Lord of Recruiting – The Lord of Recruiting is in charge of helping the founder recruit using a given message. Other responsibilities include: The Lord of Recruiting is also in charge of R.M.B recruiting (when a nation moves to another region and posts a recruitment message on the regional message board/R.M.B), Appointed by the Lord Duke with the advisement from the Royal Council and Founder.

    The Royal Council acts as the “voice” of the region’s members. This body is made up of all WA and non-WA members within the region along with the World Assembly Delegate. Has the power to draft and approve of legislation and regulate amendment changes. Made up of the following members:

    1. WA Delegate - The WA Delegate acts as Aluvean Seas’s representative in the Worlds Assembly and votes in the World Assembly in accordance to the best interests of the region. The WA Delegate’s powers are list as they following: Is in charge of forming embassies and alliances with other regions officially (meaning he/she is the one to confirm them, to make them happen), after the embassy and alliance have been voted for.


    Article 3: Election/Voting Procedure and Protocol

    Being a member of Aluvean Seas, all are entitled to the right to vote in elections and have the possibility to run in office elections. Below is the procedure and protocol for elections and voting purposes within the region.

    1. All members of Aluvean Seas, whether registered within the WA or not, are entitled to vote in elections or vote on legislation.

    Elections for WA Delegate -

    In order to be eligible to run for the position of WA Delegate, a member must meet the following:

    1. Be a member in good standing within Aluvean Seas.
    2. Announce his/her intention of running to the Royal Council with an outline of their agenda.

    Once the nations has meant the above, each candidate will be allowed one week (decided by the Founder) to promote their views and stance to the region; both within the RMB and within the forum itself (whether in a debate or other event).
    iii. Once the week of debating and promotion has passed, the Lord Duke will call for a vote to be conducted; which will last for 48 hours from the time announced.

    1. Once the 48 hour period has passed, voting will end and a winner will be announced by either the Founder. If after the round of voting there is a tie, a second and final round of voting will take place. In the event that after the second round of voting there is still a tie, the Founder will cast a vote to the candidate of his choice.
    2. After a winner is chosen, the region (ALL WA nations) will have 48 hours from the announcement of a winner to dis-endorse the previous WA Delegate and endorse the new one.

    The election for WA Delegate is held every 30 days with the WA Delegate taking office at the beginning of the month and ending his/her term at the month’s end.

    Elections for Lord Duke –

    In order to be eligible to run for the position of Lord Duke a member must meet the following:

    1. Be a member in good standing within Aluvean Seas.
    2. Announce his/her intention of running to the Royal Council with an outline of their agenda.
    3. Be a member of the Royal Council.

    Once the nations has meant the above, each candidate will be allowed one week (decided by the Founder) to promote their views and platform to the region; both within the RMB and within the forum itself (whether in a debate or other event). Once the week of debating and promotion has passed, the Founder will call for a vote to be conducted; which will last for 48 hours from the time announced.

    1.Once the 48 hour period has passed, voting will end and a winner will be announced by either the Founder. If after the round of voting there is a tie, a second and final round of voting will take place. In the event that after the second round of voting there is still a tie, the Founder will cast a vote to the candidate of his choice.

    2. After a winner is chosen, the newly elected Lord Duke will announce their speech and begin their term.

    The election for Lord Duke is held every 60 days with the Lord Duke taking office at the beginning of the month and ending his/her term at the following month’s end.

    Voting procedure and legislation –

    Voting for a piece of legislation within the chambers can be made by all members of the region and follow as such:

    1. Legislation must be formulated within the individual parties of Aluvean Seas and brought forward by either the party leader or their designee. The exception to this rule would be having the Lord Duke or Founder bringing forward legislation, as they need not to bring it up before the party they belong to beforehand.
    2. Once a piece of legislation is brought forward to the Chambers, it will be debated for a period of three days. After which, the Lord Duke will take roll call and close the Chamber for voting.
    3. Once roll call has been made and the Chamber closed, a poll vote will be taken with the cast of either “For” or “Against” being made by those members in attendance. After a 24 hour period, the voting will be ceased and the poll will be finalized. For a piece of legislation to pass, it must have a 51% “For” rate from the nations in attendance of the vote. If the said legislation does not me 51%, then the bill is defeated and brought back to the party to ratify it before it can be brought forth again. Once a bill passes with the necessary votes, the Lord Duke and Founder will sign off of it and the bill becomes law. Both the Founder and Lord Duke hold the right to veto said legislation; however it can be passed by a 2/3 votes from within the Chamber. All other proposed election and voting changes need to be amended into the Constitution before they can be implemented.

    Article 4: Judicial Procedure

    In the event that signs of misuse of membership privileges or other acts of terror within Aluvean Seas, the following procedure shall take place:

    All cases will be brought forth before the Royal Council and will be discussed openly and fairly amongst all members of the region. The region will appoint a prosecutor to act in the region’s interest while the defendant represents themselves. Each side will be given two days to debate back and forth on the charges and make a case for themselves. After the trial period, a vote amongst the members of the region shall be cast “For” or “Against” the defendant. In the case that the defendant is found guilty, another vote will take place to determine the punishment of the individual.


    Article 5: Dismissing the WA Delegate and other Governmental Officials

    In the event that neither the WA Delegate nor other government officials can perform their jobs, a call of dismissal can be called to dismiss the individuals. Note: The Founder cannot be dismissed from office as he/she is the founder of the alliance and therefore is given immunity.

    Dismissal of WA Delegate or Elected Officials –

    Any member of the region can call into question the workings and effectiveness of the WA Delegate and Elected officials. However, only an Royal Council Member or Party Leader can call a vote for dismissal within the Chamber:

    1. In the event that a vote of dismissal is called, the Founder will call forward the nation in call and the prosecution to explain their reasoning as to why or why not to dismiss. This will go on for 24 hours via Aluvean Seas forum before the case is brought to the Chamber.
    2. Once the case is brought to the Chamber and if the Founder deems that a dismissal is necessary, a vote will be cast in the answer of “For” or “Against” the dismissal of said nation. A vote of ¾ is required to dismiss a nation from office. In the event that said nation is dismissed, the Founder shall appoint a temporary officer to act in that role until the end of the term. Then an election will take place on the normal cycle.

    Concluding Statement and Code of Conduct

    In concluding with the above, we members of Aluvean Seas do so hold this Constitution to be our guide to the formation of this region. We acknowledge to follow the Constitution’s regulations and guidelines into help us become a stronger region. As such, the member nation of ____________________________________ (state your nations name) do swear to uphold the Constitution and pledge my sacred honor.
